These Silverton Gift Card Terms and Conditions (“Terms and Conditions”) are applicable in addition to the Terms of Use and Privacy Policy applicable to the SilvertonCasino.com website.
A Silverton Gift Card “Gift Card” is valid for use only at Silverton Casino, LLC owned and operated outlets (this excludes Johnny Rockets and Bass Pro Shops).
Silverton will not permit any return, refund or exchange of any Gift Cards. Silverton will not exchange Gift Cards for cash and will not cash out any remaining balances. Gift Cards cannot be used for any gaming purposes, including, without limitation, free slot play or table games.
The Gift Card must be presented at the time of redemption. Silverton will not replace a Gift Card that is lost, stolen, altered, destroyed or used without your permission.
The Gift Card program is being operated by The Customer Connection, a California corporation (“TCC”) that specializes in gift card management programs. All data regarding the Gift Card is maintained, secured and managed by TCC.
The value of any purchased Gift Card expires five years from date of issue for the amount applied. If new amounts are loaded to a purchased Gift Card, those amounts are available for five years from date the additional amounts were added to the purchased Gift Card. If the Gift Card is promotional in nature (was not purchased with cash or points), the value on the Gift Card will expire after one year of date of issue. Gift Cards may be reloaded with values from $5 to $500; a single gift card cannot exceed $500 in value. A promotional Gift Card cannot be reloaded.
Gift Cards may be used as personal or business gifts, but may not be used in connection with any marketing, advertising or other promotional activities (including without limitation, via websites, Internet advertisements, email, telemarketing, direct mail, newspaper and magazine advertisements, and radio and television broadcasts) unless you obtain Silverton’s prior written approval, Silverton’s approval may be granted or withheld in Silverton’s sole and absolute discretion.
The estimated balance may be checked on our web site, SilvertonCasino.com. The balance you see when viewing Gift Card balances online is an estimate only. In most cases, the balance is adjusted immediately when you make a purchase using the Gift Card, but there may be occasions when the updated balance is delayed for a period of time. Gift Cards and their usage are subject to change and additional restrictions. All such changes and additional restrictions will be accessible along with any balance information through content or links available on the web site at SilvertonCasino.com.
When you purchase, receive, or redeem a Gift Card, you agree that the laws of the State of Nevada shall govern these Terms and Conditions, without regard to principles of conflict of laws. Disputes, claims and causes of action at law or in equity arising out of or relating to the Gift Card may subject to the dispute resolution provisions of the Nevada Gaming Control Act and may be resolved pursuant to a regulatory decision set forth in NRS 463.362. Any and all disputes, claims and causes of action at law or in equity arising out of or relating to the Gift Card that are not subject to the dispute resolution provisions of the Nevada Gaming Control Act and not resolved pursuant to a regulatory decision set forth in NRS 463.362, shall be (a) resolved individually, without resort to any form of class action; and (b) filed only in the state or federal courts situated in Clark County, Nevada state. By holding, using or possessing a Gift Card, you hereby consent and submit to the personal jurisdiction of the courts located in Clark County, Nevada for the purposes of litigating any such disputes, claims or causes of action related to the Gift Card. You also agree that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred by you, but in no event shall include attorneys’ fees. You also agree that under no circumstances will you be permitted to obtain awards for and hereby waive all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
